The corona crisis has set a race in motion to develop a drug and vaccination for COVID-19, as the most effective treatment for the virus is still unknown, and current treatments are based on experimental medicines that have not yet been fully proven.

The scope of the legal protection that will be granted to the treatment once it is found, depends greatly on the question whether it is based on a new material, or a new usage for a previously known material. This stems from the sensitive balances in the fields of patent law and legal protection of medicines. The scope of protection that should be granted for patents protecting an additional medical use raises complex challenges, and the last word has yet to be said on the matter.
