Adv. Tal Band Senior Partner and Head of the firm's Intellectual Property Practice Group, wrote an article that was published this week in the reputable ranking directory, BDI. The article discusses the purposes, trends and various arrangements in place for obtaining Patent Term Extension (PTE) orders in Israel. Inter alia, it is noted in the article that "the purpose of the PTE order is to compensate in some way key pharmaceutical companies, for the period during which the patent is registered, but has not yet received marketing authorization for the medicinal preparation protected by it, but emphasized that care should be taken to avoid excessive compensation". These statements were made against the backdrop of the recent success in a case handled by Adv. Band in which the Manufacturers' Association of Israel won an opposition in principle concerning the submission of a PTE order and in an appeal that was subsequently filed with the District Court.
